1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of marcorforensicexpert.com (the "Site"), operated by MarcorSEN Engineering ("MarcorSEN," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

2. Description of Services

MarcorSEN Engineering provides forensic structural engineering investigations and expert-witness services. Site content — including practice-area descriptions, case examples, and educational material — is for informational purposes only.

3. Not Engineering, Legal, or Professional Advice

Information on the Site is not engineering, legal, or other professional advice, and does not create an engineer-client or expert-witness relationship. Any such relationship is formed only by a signed written engagement letter between you (or your organization) and MarcorSEN Engineering.

Do not rely on Site content in place of consulting a licensed engineer or attorney about your specific matter.

4. Contact-Form Submissions

Submitting an inquiry through the Site does not obligate MarcorSEN Engineering to accept the engagement, and does not create any expert-witness or engineer-client relationship until a conflict check is completed and an engagement letter is countersigned.

Do not send confidential or privileged information through the contact form prior to that engagement letter.

5. SMS / Text Messaging

If you opt in to receive text messages by checking the SMS consent box on the contact form, you agree that:

  • You are the owner or authorized user of the phone number provided.
  • You consent to receive text messages from MarcorSEN Engineering related to your inquiry or engagement.
  • Message and data rates may apply.
  • Message frequency varies.
  • You may reply STOP at any time to unsubscribe, or HELP for assistance.
  • Consent is not a condition of purchase or engagement.

6. Intellectual Property

The Site, including its text, graphics, logos, photography, and underlying source code, is owned by or licensed to MarcorSEN Engineering and is protected by U.S. and international intellectual-property laws. You agree not to:

  • Use the Site in any manner that violates applicable law.

TO THE FULLEST EXTENT PERMITTED BY LAW, MARCORSEN ENGINEERING AND ITS PRINCIPAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification

You agree to indemnify and hold MarcorSEN Engineering, its principal, employees, and agents harmless from any claim or demand — including reasonable attorneys' fees — arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or privacy practices of those sites and do not endorse them by linking to them.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to personal jurisdiction and venue there.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Site after changes constitutes acceptance.
